Russian Defendant With Sealed Case and
Unadmitted Lawyer

SDNY COURTHOUSE,
Jan 8 – A Russian
defendant who has been allowed
out on bail by the US Attorney
for the Southern District of
New York was given loosened
bail conditions on January 8
in the SDNY Magistrates Court
even while his case, before
SDNY District Judge Lorna G.
Schofield, remains sealed.

Magistrate Judge Debra Freeman
began the brief proceeding by
summoning the Assistant US
Attorney and the unnamed
defendant's lawyer, whose pro
hac vice application has not
been approved, up for a
whispered sidebar
discussion.
Then a
Russian language translator
went forward to the defense
table. The defendant asked if
he had to stand up.
His bail
conditions were loosened to no
longer have the FBI as a third
party custodian, and to give
him more time to come up with
the security -- $500,000 in
cash -- for his
bail. He can
have a cell phone to call his
wife, and doctors -- this was
added by Judge Freeman.
His address was
given out in open court, even
while the case remains sealed.
