As ISIS Suspect Clark
Presented In SDNY Mag Court Secrecy In Other
Cases There Misused

SDNY COURTHOUSE,
Nov 27 – An ISIS suspect will
be presented on the afternoon
of November 27 in U.S.
District Court for the
Southern District of New York
Magistrate Court - which
earlier the same day was the
locale of a total lack of
transparency, inconsistent and
at odds with not only the law
but this presentation:
"The Department
of Justice today announced
that Zachary Clark, 40, was
arrested today in Brooklyn,
New York. Clark is
charged in a criminal
Complaint with attempting to
provide material support to
the Islamic State of Iraq and
al-Sham (ISIS), a designated
foreign terrorist
organization, and distributing
bomb-making
instructions. Clark is
expected to be presented later
today before Magistrate Judge
Robert W. Lehrburger in
Manhattan federal court."
In this
Clark / ISIS case, the
Department of Justice
announces its prosecution and
includes photos
in it. But earlier on November
27 a defendant was brought in
with no docket number
given.
Assistant US Attorneys Michael
Longyear and a colleague said
quietly to Magistrate Judge
Robert W. Lehrburger that they
had made a "written
application" in connection
with the arraignment which
they did not describe.
Judge Lehrburger paused then
said he was granting the
written application, which he
also did not describe. Inner
City Press went to the office
it has been directed to go
with question and asked for
the docket number.
A staff
member began to inquire, when
it appears clear that AUSA
Longyear said no, don't tell
him. Judge Lehrburger's
deputy, who one would assume
must have the "mj" or
Magistrates Court number, told
Inner City Press there was no
number, one would have to
inquire with a District Judge,
whose door was locked.
Perhaps this defendant, who
Inner City Press is not in
this report naming, is a
cooperator. Perhaps he - or
she, we'll say - is the first
of a still sealed indictment.
But this type of bait and
switch faux transparency,
secret applications and cases
in a supposedly open Federal
courtroom, cannot be accepted.
Meanwhile Inner City Press

Freedom of Information Act
request for that, and about
death eligible cases being
handed by the US Attorney's
