SDNY COURTHOUSE,
Dec 26 – A defendant named
Winder Casilla was presented
and provisionally offered bail
on narcotics charges on
December 26.
The
hang up was getting
US Pre-Trial
Services to
check his
apartment on West
Creek Lane in
Houston, Texas, and
how he will
fly back and forth to
New York for
court
appearances
with an ankle
bracelet on.
He has a
retained
counsel named
Edward
Picardo. The
case is US v.
Casilla,
19-mj-11952.
Earlier on
December 26 a defendant named
Stephanie Perez was
unsuccessfully offered a bail
package by the US Attorney's
office on December 26 in the
U.S. District Court for the
Southern District of New York
Magistrates Court. The offered
package was for a $20,000
personal recognisance bond
co-signed by two financially
responsible people.
But SDNY
Magistrate Judge Barbara Moses
asked, What about Ms. Perez'
earlier failures to appear?
Assistant US Attorney Brett M.
Kalikow responded by referring
to "the written application we
passed up to your Honor" -
that is, a non public
document.
Judge
Moses said she had read it,
whatever it is, and that it
addressed only Ms. Perez'
intentions. Kalikow asked,
"May we approach?"
There
followed a non-public sidebar
discussion. Inner City Press
went next door and asked for
the docket number; they did
not have it. As the matter was
put over to some undefined
time, Inner City Press hopes
to have more. The previously
"Murky Mag Court" series was
converted, but issues remain.

December 26 a man who was shot
in the stomach on November 6
in the Bronx juice bar he had
opened only the month before
was approved for
publicly-funded Criminal
Justice Act legal
representation on December 26.
In a short
proceeding in an otherwise
empty, but for Inner City
Press, Magistrates Court of
the U.S. District Court for
the Southern District of New
York, Magistrate Judge Barbara
Moses asked what income he had
received from his story in
November and December so far.
None, he replied, stating that
he was in a coma for five days
and has had to return to the
hospital with an infection
from the pump in his stomach.
He said he has
left an employee in charge,
who when he calls tells him
there is no money to pay
out.
From public
reporting at the time, it
appears that it is the Healthy
Juice Bar at 700 Adee Avenue
in Allerton. Inner City Press
is not publishing the shot
storeowner's name; a photo of
the person said at the time to
be a suspect is here.
But
why would the victim need to
be appointed a CJA lawyer? No
docket number was read out,
nor any explanation
offered. On that, we may
