SDNY COURTHOUSE,
Jan 22 – Jesse Phillips is
accused of robbing the same
store clerk at 3404 Jerome
Avenue in the Bronx on October
2019 and January 2020, the
first time after displaying a
knife for $150, the second
threatening a gun for $60
more.
On January 22 the
US Attorney for the Southern
District of New York agreed
that Phillips should be
released with a bail package
of a $25,000 personal
recognizance bond. Assistant
US Attorney Thomas Burnett
added that Phillips should
"stay away from 3404 Jerome
Avenue."
SDNY Chief
Magistrate Judge Gabriel W.
Gorenstein quizically quoted
that back, "Stay away?"
AUSA Burnett
offered a longer phrase, "Not
be
permitted."
Judge Gorenstein
paused, then said he was
ordering release because that
US Attorney had agreed to it
because "the Government agreed
and I assume they have their
reasons." He wrote on the Bail
Disposition sheet, "D Not to
enter 3404 Jerome Avenue." The
proceeding took five minutes.
It is US v. Phillips,
20-mj-2017 (Gorenstein).
