SDNY COURTHOUSE,
Nov 27 – The New York
Taxi Workers Alliance has
challenged the NYC Taxi and
Limousine Commission's policy
of summarily suspending the
taxi license of any driver who
is arrested on a felony or any
of 18 misdemeanor charges, in
the U.S. District Court
for the Southern District of
New York.
On July 10 Judge
Richard J. Sullivan, sitting
by designation back in the
SDNY where he previously
addresses this issue in Nnebe
v. Daus, 06-cv-4991, held a
proceeding. Inner City Press
covered it.
The
drivers are moving for class
certification and want Judge
Sullivan to appoint a master
pursuant to FRCP 53.
The City says it
provides prompt
post-suspension hearings. But
is that due process?
The case is
