SDNY COURTHOUSE,
Oct 27 – William J. Rivera was
hired by ADP and Demar
Mechanical on October 7,
2019.
He has Fahr's
Syndrome, "a rare, genetically
dominant, inherited
neurological disorder
characterized by abnormal
deposits of calcium in areas
of the brain that control
movement."
On December 20,
2019 Rivera started to feel
dizzy. He was allowed to work
from home. On December 30 his
supervisor Alex texted, Are
you back to work? By January
23, 2020 he was fired and his
insurance was canceled. He
sued.
On October
27 U.S. District Court for the
Southern District of New York
Judge Mary Kay Vyskocil held a
proceeding. Inner City Press
covered it.
Judge Vyskocil explained the
need for an inquest on
damages, given that the
plaintiff was only out of work
for a week but wanted a big
award. Counsel, don't argue
with me, just address the
points.
The case is
Rivera v. ADP Totalsource FL
XVI, Inc., et al., 20-cv-4787
(Vyskocil)
