SDNY COURTHOUSE,
July 18 – Givaudan SA sued
Conagen Inc. in 2018 seeking
among other things the return
of a $10 million advance paid
under an agreement between the
two.
On
June 6, 2022 U.S. District
Court for the Southern
District of New York Judge
John G. Koeltl began an
in-person bench trial in the
case. Inner City Press went
and covered it.
The
witness was asked about DX 12,
described in the docket at the
Common Stock Purchase
Agreement and labeled
"Confidential."
Reference was
made to confidentiality for a
Mr. You, apparently Holly You
reference in DX 14.
Jump cut to July
18, when the decision in the
bench trial was rendered:
"MEMORANDUM OPINION AND ORDER:
Conagen is not liable for
Breach of Contract, Promissory
Estoppel, or Unjust
Enrichment, and thus, Givaudan
is entitled to no relief on
its claims against Conagen.
Givaudan's claims against
Conagen are dismissed. The
Clerk is directed to enter
judgment dismissing this case.
The Clerk is also directed to
close all pending motions and
to close this case. SO
