SDNY COURTHOUSE,
Nov 9 – Netflix was sued
in Texas on four patents in
2019. The case has been moved
north and on June 12 U.S.
District Court for the
Southern District of New York
Judge Gregory H. Woods held a
proceeding. Inner City Press
covered it, below.
Now on
November 9, with the case
transferred to SDNY Judge John
P. Cronan, another proceeding
was held. Inner City Press
also covered it. Fact
discovery was set to end
November 6, while expert
discovery goes to March 26.
Judge Cronan asked questions
then for more briefing. The
case is now
Personalized
Media
Communications,
LLC v.
Netflix, Inc.,
20-cv-3708
(Cronan).
The question back
in August was whether Netflix
can file a motion to dismiss
now, or should wait for a
summary judgment motion.
Personalized Media
Communications LLC seeks a
"reasonably royalty" or a
trial in the first quarter of
2021.
On August
25 Judge Woods held another
another proceeding in the case
and Inner City Press again
covered it. This time, Judge
Wood sided with PMC, that it
is too early to require pin
cites to the underlying source
code.
The case is
Personalized Media
Communications, LLC v.
Netflix, Inc., 20-cv-3708
(Cronan).
