SDNY COURTHOUSE,
July 20 – Touro College was
sued on May 22 in a putative
class action by those who
"paid tuition and fees for the
Spring 2020 academic semester"
but due to COVID-19 "lost the
benefit of the education for
which they paid."
On July 20
U.S. District Court for the
Southern District of New York
Judge P. Kevin Castel held a
proceeding in the case. Inner
City Press covered it.
Judge
Castel asked the parties if
they've heard of "hybrid,"
which he said existed before
the COVID pandemic. Yes, they
replied, but this is
different. The plaintiffs'
lawyer floated the idea of an
unjust enrichment
theory.
Judge Castel gave Touro until
August 14 to either file an
answer or file a pre-motion
letter, presumably a motion to
dismiss.
There will be
many more such lawsuits. This
one is Chapusette v. Touro
College and University System
et al., 20-cv-4018 (Castel)
