Fitness Everywhere Says It Was Sued For Inaccessible Website From California Now NY

SDNY COURTHOUSE, Jan 4 –   Fitness Everywhere was sued for having a website allegedly inaccessible to the visually impaired. Twice.  

  On January 4 U.S. District Court for the Southern District of New York Judge John P. Cronan held a proceeding. Inner City Press covered it.

  The lawyer for Fitness Everywhere said the company was sued by a California law firm and settled, making improvements. Then it has been sued again. He said while the site is not perfect, it can be navigated, that the failure to have "alt" descriptions of all photos does not mean it is inaccessible.

  Judge Cronan thanked the parties for trying to work this out - in advance? - and considered the Case Management Plan with its discovery cut off of July 30.

 The case is Paguada v. Fitness Anywhere LLC, 20-cv-8480 (Cronan)
