Defendant Whose Debevoise CJA Lawyer Wants To Be Prosecutor Asks For Curcio Counsel

SDNY COURTHOUSE, Feb 6 – Adea Byrd, charged with Hobbs Act robbery, was assigned as his legal representative the white shoe law firm of Debevoise & Plimpton LLP.

Then his Debevoise lawyer Eric W. Silverberg decided to apply to become a prosecutor.    

 On February 5, U.S. District Court for the Southern District of New York Judge Victor Marrero held a Curcio hearing. Inner City Press covered it.  Judge Marrero asked Byrd the requisite questions but things did not go smoothly.

First, Byrd said he had known that Silverberg wanted to be a prosecutor - but not with the same SDNY office that charged him.   Then when asked if he would like to discuss the conflict with another, non conflicted lawyer, Byrd said Yes. 

 Judge Marrero arranged for the day's CJA duty lawyer to talk with Byrd. Another Devevoise lawyer said maybe just Silverberg could step away. We'll see.

The case is US v. Byrd et al., 20-cr-357 (Marrero)
