SDNY COURTHOUSE,
Feb 20 -- When Gilberto
Minaya-Rodriguez argued to be
released on bail on narcotics
and money laundering charges,
he had a white shoe law firm
lawyer from Cleary Gottlieb.
But U.S. District Court for
the Southern District of New
York Magistrate Judge Barbara
C. Moses asked Assistant US
Attorney Ryan B. Finkel to
explain why he was offering
bail when Minaya-Rodriguez is
not a citizen and might
flee.
Finkel admitted
he was filling in for another
AUSA, who he left unnamed.
The Cleary
Gottlieb lawyer, who took on
11 cases on the day, managed
during a break to get a cell
phone photo of his client
expired residence card and a
superseding Department of
Homeless Security passport
stamp.
Judge
Moses offered conditions for
release, but in such a way
that the real AUSA, or US
Attorney himself, has time to
appeal or otherwise oppose
release. The case is US v.
Minaya-Rodriguez, 20-cr-59
(Broderick / Moses).
