SDNY COURTHOUSE,
March 11 –
China based Guangzhou
Baiyunshan Pharmaceutical
Holdings Co., Ltd has been
sued for trademark
infringement by Multi Access
Limited.
There is a
problem, though. The Chinese
government does not permit
depositions taken in China to
be used
elsewhere.
On March 11, U.S. District
Court for the Southern
District of New York Judge
Lewis J. Liman held a
proceeding. Inner City Press
covered it.
The parties
discussed the problems of
Chinese law.
They are to
meet and confer and file a
letter on the docket whether
the Defendants' pending motion
to dismiss will be withdrawn
and re-filed if the deposition
in China is not able to be
taken by April 15. There is a
seemingly overbroad request
for sealing.
The case is Multi
