SDNY COURTHOUSE,
Sept 10 – Omar Santos
Hernandez sued Relay Delivery,
Inc. for not paying minimum
wage.
On September 6,
2022, U.S. District Court for
the Southern District of New
York Judge Gregory H. Woods
held a proceeding. Inner City
Press covered it.
A proposed
stipulation of voluntary
dismissal had been filed on
September 2.
But on
September 6, Judge Woods
questioned whether it complied
with the Second Circuit's
decision in Cheeks.
On September 7 he
ordered the parties, by
September 13, to file a plan
to go forward or a request to
dismiss under Rule 41(a)(2).
The case is
Santos Hernandez v. Relay
Delivery, Inc. et al.,
19-cv-11888 (Woods)
