SDNY COURTHOUSE,
March 2 -- A man in from
Seattle with an interpreter
was assigned free Criminal
Justice Act counsel Louis M.
Freeman on March 2, with the
assigned backdated "nunc pro
tunc" to
December.
Magistrate
Judge Kevin N. Fox of the U.S.
District Court for the
Southern District of New York
asked Freeman why he should
back date the appointment, and
thus the payments.
Freeman, a
CJA counsel from as far back
as 2000, said that he was the
CJA on duty on December 13 and
began representing the
material witness, whose name
sounds like Nazarani.
But
because Nazarani lives in
Seattle and only comes to New
York on the weekend, he
believed there was no way to
present the required financial
affidavit.
Magistrate
Judge Fox reminded Freeman
that there are now video
programs like Facetime and
Skype, and to use those in the
future. In fact, Inner City
Press has seen orders signed
in the Magistrates Court with
only audio, when Facetime
didn't work.
There was
no indication, in this semi
public proceeding, of what
case Nazarani is a material
witness in. Therefore, there
is no docket number. But Inner
City Press will remain "on the
case," for now figuratively if
not literally. Watch this
