SDNY COURTHOUSE,
March 3 -- When Jesus Gomez
was first presented it was for
23 kilos of heroin,
before U.S. District
Court for the Southern
District of New York
Magistrate Judge Katharine H.
Parker on March 28, 2019. He
was assigned a Criminal
Justice Act lawyer, Jeremy
Schneider.
But when SDNY
District Judge Paul A. Crotty
held a second arraignment on
April 4, 2019, Schneider said
he was being replaced by
retained (paid) counsel from
California.
He said that California lawyer
had wanted him to stay on as a
local counsel but that as CJA
lawyer on the case he could
not accept (outside) money:
"I actually spoke
to the clerk as well as
referred to the CJA rules
which specifically prohibits
[sic] me from accepting any
money on a CJA case. So, that
being said, I have informed
counsel out in California that
I cannot appear as local
counsel, he will have to make
whatever arrangements he need
to have local counsel
appear."
On March 3, 2020
Inner City Press was back in
SDNY Magistrate Court when
Jesus Gomez pled guilty not to
23 kilos but 100 grams of
heroin, the lesser included
offense. The sentencing was
set for June 3. The case is US
v. Gomez, 18-cr-490 (Crotty /
Fox).
