SDNY COURTHOUSE,
Nov 9 – Jacob Frydman filed a
RICO and defamation lawsuit
against Eli Verschleiser and
others in 2014.
On October
24, 2022, U.S. District Court
for the Southern District of
New York Judge John G. Koeltl
was presiding over the trial.
Inner City Press went and
covered it.
The
defense, even after eight
years, made an eleventh hour
request for an adjournment of
the trial. It was not granted.
Arguments
about the admissibility of
exhibits are to be submitted
in writing - while some
exhibits are Internet
postings, others are articles
as to which hearsay exceptions
might apply.
Judge Koeltl told
the parties it would benefit
both sides not to rule on
objections in front of the
jury and give the impression
either of obstruction or
overreach.
While Judge
Koeltl gave preliminary
instructions to the ten
selected jurors and
alternates, one of the defense
counsel came to the back of
the courtroom and asked Inner
City Press what its connection
to the case is.
Press, was the
answer.
He asked,
"Are you here because of
Jacob?"
The
initial complaint in the
docket omits pages 2 through
21.
On October 25,
Frydman was on the witness
stand, listing damages in
connection with Bancorp and
square footage price of real
estate. There were substained
objections to attempted
testimony about Intermedia and
"Host Pilot" logs.
On October 26,
Frydman was still on the
stand, walking through small
type Excel spreadsheets the
jurors strained to look at on
their screens. He was asked,
on direct, to define EBITDA.
Why, earnings before interest,
taxes, depreciation and
amortization, of course.
On November 9,
formalized into the docket,
this: "Minute Entry for
proceedings held before Judge
John G. Koeltl: Jury Trial
completed on 11/7/2022. Jury
verdict for plaintiffs against
defendant Eli Verschleiser for
$1,433,005, plus $700,000
punitive damages, for total of
$$2,133,005. (Court Reporter
