SDNY COURTHOUSE,
Oct 8 – The owner of 1212
Avenue of the Americas is
suing The Gap for non-payment
of rent, over $1
million.
On October 8 U.S.
District Court for the
Southern District of New York
Judge Paul G. Gardephe held a
proceeding. Inner City Press
covered it.
The parties
agreed that in New York in
March 20, the COVID
regulations resulted in Gap
sales there being suspended.
But did it cancel or frustrate
the express purpose of the
lease?
The Gap
wants to stay the case and
transfer it elsewhere, to
consolidate it with other
cases.
The
landlord, on the the hand,
wants to get paid. The
Judicial Panel on
Multi-district Litigation held
a hearing on September 24 and
a decision is expected in the
coming weeks.
The case, for
now, is 48th Americas LLC v.
The Gap, Inc., 20-cv-3471
