SDNY COURTHOUSE,
Juny 4 –
Victor Hidalgo was being
sentenced as part of a
Washington Heights drug
conspiracy, by U.S. District
Court for the Southern
District of New York Chief
Judge McMahon on June 4. Inner
City Press covered it.
The US Attorney wanted between
262 and 327 months. The
defense wanted the five year
mandatory minimum. saying
he'll be deported after.
The
Assistant US Attorney says
Hidalgo already came back to
the US once after a felony. So
for deterrence, she says, the
full 262 months are needed.
Defendant is 59 years old, and
on the BOP's list of inmates
at most risk of COVID-19.
Mr Hidaldo was uniquely
situated, he was "general
manager of the day-time
managers of the
pitchers."
Mr Hidalgo says, in Spanish,
"No I do not have anything to
say."
Judge
McMahon said she came up with
same at Probation's
recommendation. He is held
responsible for 85 kilos of
heroin, as the one who
maintained the stash house.
"Just this morning I got a
letter that a sentenced
prisoner will be sent to one
of three quarantine centers in
the US, isolated for 14 days
before moving on."
Judge McMahon: It is
unfortunate Mr Hidalgo
committed his crime at the
time that he did, but he needs
to be punished. Notes that
defense attorney "obliquely"
referred to an inmate dying of
COVID19 [Inner City said it
would look into it; it seems
to involve the pepper spraying
of Jamel Floyd to death in the
MDC.]
Judge
McMahon sentenced Hidalgo to
ten years, to be followed by
deportation. He is informed
that he waived his right to
appeal anything below 327
months. Hidalgo now
speaks, "120 months means I
will die in jail. Because I am
sick... I don't know what to
say now."
Judge
McMahon offers to put Mr.
Hidalgo and his lawyer in a
private "room" - with
interpreter - to discuss. The
pending question was whether
he understands that he waived
his right to appeal this
sentence in the plea
agreement.
Hidalgo returned, said only
that he needs gout medicine.
It will be conveyed to
marshals.
The case is US v.
Hidalgo, 18-cr-802 (McMahon).
