SDNY COURTHOUSE,
June 15 – In a Fair Labor
Standards Act case against New
Ooki Sushi, Inc.,
Flushing-based lawyer Ricardo
R. Morel on June 15 accused
his adversary of, in a word,
lying.
The proceeding
was before U.S. District Court
for the Southern District of
New York Judge Gregory H.
Woods, and Inner City Press
covered it.
Alice C. Zhang,
also of Flushing and
representing New Ooki Sushi,
has replied that "if not for
the coronavirus pandemic and
On-Paulse [sic] order,
Defendants may find out the
instant action through the
advertising mails earlier
which may avoid the
default."
But on
June 15 Morel recounted the
steps taken to serve process,
and asked that default not be
vacated, notwithstanding the
Second Circuit's preference
that matters be resolved on
their merits. He asked for an
evidentiary hearing.
The case is Tian
v. New Ooki Sushi, Inc. et
al., 20-cv-1950 (Woods).
