SDNY COURTHOUSE,
March 20 -- Lael Young was on
probation when US Homeland
Security Investigation was
tipped that he was "hiding
drugs and weapons" in his
apartment.
On February 11
Probation Officers found nine
bullets in his apartment, but
did not arrest him on that
day. Rather, he was arrested
and presented on March 20
before U.S. District Court for
the Southern District of New
York Chief Magistrate Judge
Gabriel W. Gorenstein, who was
wearing gloves amid the
Coronavirus crisis.
The virus
played a role in Young's
argument to not be sent to the
MCC. The government on the
other hand cited a music video
Young put on line while on
probation in which he
brandished what appeared to a
gun, the Assistant US Attorney
said.
Young's lawyer said she
doubted the AUSA even saw the
video, adding that it was from
years ago and in any event
protected by the First
Amendment.
Judge Gorenstein said he
rejected the First Amendment
argument, that it was fair to
draw inferences from such a
video. But he ordered Young
released on $25,000 bond. The
case is US v. Young,
20-mj-2702 (Gorenstein).
