In SDNY Drug Case Defendants in Arizona Appearing Via Teams Extended To March 2021

SDNY COURTHOUSE, Dec 3 -- On March 20 amid Coronavirus three defendants were presented in a single narcotics case. One was released sent to a flight to Arizona while the other two were detained.    

   Jimmy Lopez Arizmendi was the lucky one. He was charged like the other two with one kilo of heroin and 40 grams of fentanyl. But AUSA Amanda Johnson agreed with CJA counsel he could be bailed to Arizona (his flight was canceled).

  Christian Omar De La Torre Villavazo on the other hand after a lot of discussion was detained on consent. Hector Carrillo-Villa's lawyer Sabrina Shroff said her client would have sought release on bail except ICE detention would be worse. 

  SDNY Chief Magistrate Judge Gabriel W. Gorenstein said, with seemingly sympathy, You have to do what you think is best for your client.

  On December 3 the three defendants appeared before SDNY Chief Judge Colleen McMahon. Consent was given to appear from Arizona, via Microsoft Teams. Time was excluded through March 10, 2021.

 After the proceedings, at first the case did not appear at all in PACER. Then it appeared, with no filings. It is US v. De La Torre Villavazo, et al, 20-cr-584 (McMahon).
