Maleh Is Detained Because Hard to Extradite

SDNY COURTHOUSE,
Oct 22 –
Benzion Zirkind was arrested
and released on money
laundering charges on July 21
in the U.S. District Court for
the Southern District of New
York.
But on
October 22 in the same case,
co-defendant David Maleh was
ordered detained as a flight
risk. He has an Israeli
passport, possibly expired,
and the AUSA said it is nearly
impossible to extradite
Israeli citizens back from
Israel. Maleh is detained, and
the case continues to move
toward trial.
Back in July
Zirkind put up a $100,000 bond
secured by a property at 1349
President Street in Brooklyn
owned by a friend of the
family.
SDNY
Magistrate Judge Barbara Moses
held a proceeding late on July
21, and Inner City Press
covered it.
Benzion
Zirkind unlike most defendants
in the SDNY had retained
counsel, who announced that he
had "four
questions."
Judge Moses joked that those
should be for the youngest
child.
One of the
questions was how the
defendant should avoid
speaking with co-defendants,
if some of them are sealed.
More, apparently, will be
family members.
The
President Street property is
valued at over $2 million.
The next court
dates were before District
Judge Denise L. Cote. She has
ordered, "ORDER as to Emiliano
Bomba, Brian Para Machado,
Jose Baez, Andy Garibaldi
Lopez, Zalmund Zirkind,
Benzion Zirkind. On July 21,
2020, defendant Benzion
Zirkind ("Zirkind") was
presented and arraigned before
the Magistrate Judge. Pursuant
to 18 U.S.C. § 3161(h)(7)(A),
time was excluded by the
Magistrate Judge until July
29, 2020. It is hereby ORDERED
that pursuant to 18 U.S.C. §
3161(h)(6) time is excluded
until December 7, 2020, since
he is joined for trial with
Emiliano Bomba, Jose Baez, and
Andy Garibaldi Lopez. IT IS
FURTHER ORDERED that trial is
scheduled for Bomba, Lopez,
Baez, and Zirkind for December
7, 2020. The Government shall
file a letter by July 31
describing the schedule for
the production of discovery to
Zirkind. Any defense motions
are due September 4, 2020; the
Government's opposition
remains due September 11,
2020. IT IS FURTHER ORDERED
that defense counsel for
Zirkind shall advise the Court
by July 31, 2020, whether the
defendant requests a
conference with the Court
regarding the schedule in this
case or any other issue. That
letter shall confirm that
counsel has advised Zirkind of
the December 7, 2020 trial
date and the need to request
any change of counsel well in
advance of December 7 so that
replacement counsel is
prepared to try this case on
