SDNY COURTHOUSE,
March 10 –
Fab Mill Inc. was
sued for allegedly not paying
for $1,209,678.53 worth of
garments.
On March
10 a public proceeding in the
case was calendared in the
U.S. District Court for the
Southern District of New York.
Inner City Press called in and
when asked, identified
itself.
The
defense lawyer for Fab Mill
Inc. repeatedly demanded to
know by what right the Press
was on the line.
The
courtroom deputy said, it's
public like in a court room.
After that, the defense lawyer
repeated to the judge, I don't
know why they are
on.
During the
lull Inner City Press checked:
Fab Mill Inc. of 499 Seventh
Avenue, NYC took $137,000
from the Paycheck Protection
Program via OneWest Bank, a
division of CIT / First
Citizens.
Eventually
the plaintiff's lawyer, listed
in Flushing, Queens called in
and said that a settlement is
being reached between the
parties. (The defense lawyer
said he was calling in from
Kansas City).
A filing is due
in three weeks.
The case is
Nantong Sanhai Garment Co.,
Ltd. v. Fab Mill Inc. et al.,
21-cv-859 (Buchwald)
