SDNY COURTHOUSE,
June 11 – Harvey
Jackson, "present by camera
from the MCC," was to be
sentenced on June 11 U.S.
District Court for the
Southern District of New York
Judge Ronnie Abrams. Inner
City Press covered it.
Judge
Abrams began, "pursuant to the
CARES Act. I myself am in the
District."
Jackson had
pleaded guilty to a concealed
.25 Baretta, and was and is
seeking a time served sentence
for his guilty plea of being a
Felon in Possession (of a
firearm).
He is seeking a
downward departure, saying
that CHC "over-represents the
seriousness of the defendant's
criminal history."
Abrams ruled
there should be a downward
departure, but not as much as
is being requested. She'll
drop him from Criminal History
Category 4 to 2. Jackson faced
guideline of 27 to 34
months.
The
AUSA says he covered a gun in
a public place.
Judge
Abrams asked, Do you have
information what he was doing
with the gun?
The AUSA
replied, I do not. He seems to
be saying it was for his
protection. But this is a
cycle.
Jackson's
lawyer cited COVID-19 in the
MCC.
Judge
Abrams noted, I didn't see any
medical records... I'd like to
adjourn in order to get that
information. Write me a letter
when you can provide the
documentation and we can get
back on the calendar for the
CourtCall.
The case is US v.
Jackson, 19-cr-492 (Abrams).
