SDNY COURTHOUSE,
Oct 15 – Casper Sleep
sued DreamCloud for stealing
its Google Search traffic.
On October
15 U.S. District Court for the
Southern District of New York
Judge Paul G. Gardephe held a
proceeding. Inner City Press
covered it.
Substantively,
Judge Gardephe so-ordered a
case management plan providing
that expert discovery is due
by May 4, 2021, with a
five-day trial predicted.
Judge
Gardephe recounted that when
he was in private practice he
worked at a firm representing
Johnson & Johnson,
specifically its Tylenol brand
in litigation with Advil. He
said it was a war, perhaps not
worth the money spent on it.
The implication was, think of
settling.
This case is
Casper Sleep Inc. v. Nectar
Brand LLC et al., 18-cv-4459
(Gardephe)
