SDNY COURTHOUSE,
July 31 – The US Department of
Education has been sued for
changing its sexual harassment
rules to track the Davis
decision and no more.
On July 31 U.S.
District Court for the
Southern District of New York
Judge John G. Koeltl held oral
argument. Inner City Press
covered it.
The plaintiffs
argued among other things that
the Board of Education under
Betsy DeVos now ignored
hostile environment
discrimination.
The US
Attorney's Office, in defense,
said it is better to track the
applicable language rather
than create confusion.
Judge Koeltl
asked by analogy about DACA.
The case is State
of New York v. United States
Department of Education et
al., 20-cv-4260 (Koeltl)
