SDNY COURTHOUSE,
Aug 13 –
Yamill Irizarry-Santana was
arrested back on May 26, and
appeared that afternoon before
U.S. District Court for the
Southern District of New York
Magistrate Judge Ona T. Wang.
Inner City Press live tweeted
it. Irizarry was in the cell
block with the U.S. Marshals.
His Federal
Defender Martin Cohen spoke to
him by phone. The arrest took
place at 9 am in the morning
for an alleged violation of
sex offender registration.
AUSA David
Robles says Irizarry was an
"absconder." Says, "the
pandemic is serious, but the
defendant is a risk of flight
and danger to the community.
He's 33 and not in high risk
category."
Judge Wang:
For defendants brought in, is
it still the process to
quarantine for 2 weeks?
AUSA Robles: I
don't want to
misspeak...
Judge Wang: My
other concern is if Mr.
Irizarry is released with
electronic monitoring, he
doesn't have a domicile
Probation officer: He would be
directed to self-quarantine
before we could install the
equipment. And the locations
they're giving, he hasn't been
there for over a month.
FD: I meant he intends to go
there.
Probation:
He would have to go to intake
first.
Judge Wang
took a break and then
returned. She said Irizarry
should be detained.
And he was.
But then he wasn't. Because on
August 13 he was arrested
again, and as it happen was
presented before Judge Wang
again. This time he was
released: proceedings held
before Magistrate Judge Ona T.
Wang: Initial Appearance re:
Revocation of Supervised
Release as to Yamill Irizarry
held on 8/13/2020. Date of
Arrest: 8/13/2020. AUSA David
Robles. Defense Counsel Julia
Gatto (Federal Defenders).
Proceeding: VOSR. BAIL
DISPOSITION: $500.00 PRB;
Travel restricted to
SDNY/EDNY; Surrender travel
documents (& no new
applications); Defendant to be
released on own signature;
Prior conditions of bail to be
met; Present to intake shelter
as soon as possible - no later
than noon on Friday. Notify
probation when at shelter.
Must report in person, to
probation 8/18/20 at 10am.
ADDITIONAL PROCEEDINGS:
Preliminary Hearing Date:
8/27/2020." And so it
goes.
This case is US v. Irizarry,
15-cr-329 (Furman /
Wang).
