SDNY COURTHOUSE,
Sept 1 –
Yamill Irizarry-Santana was
arrested back on May 26, and
appeared that afternoon before
U.S. District Court for the
Southern District of New York
Magistrate Judge Ona T. Wang.
Inner City Press live tweeted
it. Irizarry was in the cell
block with the U.S. Marshals.
His Federal
Defender Martin Cohen spoke to
him by phone. The arrest took
place at 9 am in the morning
for an alleged violation of
sex offender registration.
AUSA David
Robles says Irizarry was an
"absconder." Says, "the
pandemic is serious, but the
defendant is a risk of flight
and danger to the community.
He's 33 and not in high risk
category."
Judge Wang:
For defendants brought in, is
it still the process to
quarantine for 2 weeks?
AUSA Robles: I
don't want to
misspeak...
Judge Wang: My
other concern is if Mr.
Irizarry is released with
electronic monitoring, he
doesn't have a domicile.
Judge Wang
took a break and then
returned. She said Irizarry
should be detained.
And he was.
But then he wasn't. Because on
August 13 he was arrested
again, and as it happen was
presented before Judge Wang
again. This time he was
released.
Now on
September 1 he was to appear
before SDNY District Judge
Jesse M. Furman. But he
refused to come out of his
cell in the Essex County Jail.
The case continues to raise
issues, about access to
lawyers and how courts deal
with it. Inner City Press live
tweeted:
Judge Furman says
another possibility is an
in-person proceeding, of the
type he intends to restart on
a limited basis next Thursday.
"If the Marshals could produce
him in person."
FD Flood: I'm
game your Honor. Sounds great,
would solve a lot of
difficulties.
Federal Defender
Chris Flood: If I could speak
with him in the Marshals'
lock-up before. Judge Furman:
I'm not sure, also not sure if
past the time to request an
in-person proceeding. At MDC
& MCC they are
quarantining those who are
produced in court, for 14 days
after...
Judge
Furman: It seems Essex is a
bit more flexible in terms of
time slots than the MCC &
MDC are. Let's go tentative
next Thursday Sept 10 at 2 pm,
in person if doable, or remote
if Mr. Irizarry prefers. Mr.
Flood, try to set a time to
speak with him. Stay safe.
