In SDNY Virtual Mag Court Defendant Bailed To Georgia But Case Not Yet Wheeled Out

SDNY COURTHOUSE, June 11 – Since March 2020 there have not been in-person criminal presentments in the U.S. District Court for the Southern District of New York, which Inner City Press reported on hundreds of cases in the Magistrates Court on the fifth floor.

  Instead, presentment are by phone and now video. But there is no list, no way to know when they happen.

On June 11 Inner City Press searching for a criminal proceeding before a District Judge who does not list his call-in numbers called the CourtCall line - and stumbled on a presentment. But of who? Or whom? 

  The defendant, whose name Inner City Press could not catch and is not yet listed in PACER, was bailed to Georgia, seemly by SDNY Magistrate Judge Debra Freeman (the deputy was "Aisha" Bams).  

 But then a problem arose.

This was proceeding by notice of intent to proceed by Information.

So who was the assigned District Judge?

The answer was, or seemed to be, that it had not yet been wheeled out.

Neither Federal Defender Julia Gatto nor the AUSA knew.

  This is all a work in progress, and people are doing the best they can. But a return to in-person proceedings is much needed.
