SDNY COURTHOUSE,
July 2 – Kevin Yan Luis,
a blind person, sued The
Yankee Candle Company, Inc.
under the ADA for having an
inaccessible website.
On June 30,
2022 U.S. District Court for
the Southern District of New
York Judge Denise L. Cote held
a proceeding. Inner City Press
covered it.
There are many
such cases in the SDNY - and a
recent precedent in the EDNY
that websites are not public
accommodations for purposes of
the ADA.
In this
case, Judge Liman said
depositions are due by
September 30, with a status
conference scheduled for
January 19, 2023.
