Hylton Robbed Bank Then Enforced Medication For Competence So Time Served Now VOSR

SDNY COURTHOUSE, Jan 21 –  David Michael Hylton was arrested for allegedly robbing a bank with what appeared to be a shotgun.

But at the time of arrest he was found to not be mentally competent. So he was imprisoned and ordered medicated. He was "restored to competence" and pled guilty.

On July 30 he appeared for sentencing before U.S. District Court for the Southern District of New York Judge Denise L. Cote. Inner City Press live tweeted it:

 Judge Cote: Sentencing was to have been May 15. But, the pandemic. We have been waiting for this date for some time. I have received a proposed order of restitution, and a of forfeiture, for $7,210. I'm going to sign it. [The name of the bank has been sealed]

Judge Cote: The bank robbery was with what appeared to be a shotgun. In the record it is claimed that his mental health deterioration was because he was incarcerated. I disagree. It was longstanding.  "He was not competent at the time he came into custody."

Judge Cote: The defendant refuses to take his medication. So it is forcibly administered. The protection of society is a major concern on my part. 

Federal Defender: The issue is to make sure he maintains his progress. He has been injected for some time.

Judge Cote: The defendant has been in custody for two and a half years. I am ordering him released, but staying the order for one week to give Probation a chance. 

On January 21, 2022 Judge Cote convened a Violation of Supervised Release proceeding with Hylton in the Hudson detention facility.

The case is US v. Hylton, 18-cr-102 (Cote)
