SDNY COURTHOUSE,
Jan 28 – Danny Bang and Cuong
Bang were charged with
narcotics conspiracy involving
10 kilograms of
methamphetamine.
On June 8 Danny
Bang's lawyer appeared before
U.S. District Court for the
Southern District of New York
Judge Lewis J. Liman; Inner
City Press covered it.
It emerged
that Danny Bang has scheduled
a change of plea - that is, a
guilty plea - proceeding for
September 25.
That took place
on October 5, and Inner City
Press covered it. An hour
later, Cuong Bang called in
from California. He is will to
submit a Safety Valve proffer,
but only in writing.
His lawyer
Sabrina Shroff explained that
a client should have his
lawyer by their side for such
a proffer, not far away on
Zoom. She cited another case,
US v. Rico, 18-cr-661, where
the US Attorney's Office
accepted a written proffer.
AUSA Elizabeth
Hanft, who appeared in both
Bang proceedings, said her
Office is unlikely to accept a
written proffer, saying
seemingly dismissively that
Ms. Shroff can send in
whatever she wants.
In
this case, Judge Liman said, I
am the judge, you will not
speak over each other. There
appeared to be an April 19,
2021 trial date.
Now on January 28
there was another conference,
and Inner City Press again
covered it. Cuong Bang's
lawyer Sabrina Shroff said a
safety valve proffer is still
not possible. Judge Liman said
he disagrees. The trial was
(re) set for May 10, with a
final pre-trial conference on
May 6.
The case is now
US v. Bang et al., 19-cr-213
(Liman).
