SDNY COURTHOUSE,
July 31 – On July 29 there was
a car chase in The Bronx
resulting in four defendants
being arrested and a Glock and
$200,000 being recovered.
On July 30 the
four were presented before
U.S. District Court for the
Southern District of New York
Magistrate Judge Sarah Cave,
one by one. Inner City Press
covered each proceeding and
live tweeted it, beginning
with Defendant 3:
We're on
Defendant 3: lawyer says he
just went for a ride in a car
which had Glock & $200,000
in it.
First defendant
in the case, just after 5 pm,
was detained on consent. On
Defendant 2, US Attorney
agreed to release on $50,000
bond - returning to courthouse
tomorrow for GPS bracelet
(Location Monitoring person
left at 5 pm, like yesterday)
Now US Attorney
opposes release of Defendant
3, whose lawyer says "he
co-defendant was his boss, and
it was a hot night."
AUSA: We have
Facetime video with the
console or trap in the car
open with $200,000 in it.
Defendant 3 was there. Why did
he run from the DEA?
Judge Cave: Was
the money put into the car at
the restaurant? AUSA: Unclear.
Earlier the only car in the
parking lot was the Equinox.
(Laughs). Three were in the
Equinox. Defendant 3 was alone
in the Suburban with the
Glock.
Defendant
3's lawyer (D3L): What did you
do wrong? Other than go for a
drive with the wrong
people? Judge Cave: Who
would sign a bond for him?
D3L: He has an uncle who owns
a business that does very
well.
Judge Cave:
I am prepared to rule. Last
night's events concern me. But
Defendant 3 was not the
driver. He was apprehended
quickly after he got out of
the car. There is another way
to look at all of these facts.
Judge Cave: Yes
he was in a car with a gun and
cash. But what was Defendant
3's connection to these? I
think he has rebutted the
statutory presumption and
there are conditions to assure
his appearance in court and
safety... $50,000 bond,
self-installation of GPS
Judge Cave: It
does concern me that you tried
to flee. But maybe you were in
the wrong place at the wrong
time. Stay safe. We are
adjourned.
And we're
back - Defendant 4 is up, and
AUSA is arguing for detention.
It was D4's Suburban with the
gun and money in it. Let's
see. AUSA: "This is a felon
possessing a loaded Glock, 8
bullets in the chamber,
$200,000 in the trap, seeking
to buy 10 kilos of coke"
AUSA: "Here Pre
Trial Services is recommending
detention which is rare... "
Judge Cave: Is there a history
between D4 with the others?
[Two of whom have been ordered
released this evening.
Pre-COVID, this might have
been a 4 defendant
presentment. Now, 1 by 1]
Defendant 4's
lawyer: We propose $500,000
bond, with $200,000 of it in
cash [!]
Defendant
4's lawyer: He disputes he
owns the Suburban. He disputes
he tried to run over the DEA
agent. His mother is an
employee of the IRS. And he is
technically obese.
AUSA: There
is an increase in crime and
guns in The Bronx during
COVID. Defendant 4 should not
be able to use COVID as a get
out of jail free card. He fled
on foot, extreme consciousness
of guilt. He claims to be the
unluckiest man in the world
[after Defendant 3]
Judge Cave:
I am detaining Defendant 4 -
but setting it down for a
further bail hearing next
week. Pre-trial services was
not able to reach D4's family
members, I don't know that
influenced their
recommendation. I want to give
time to give information on
the properties.
