SDNY COURTHOUSE,
June 15 – U.S. District
Court for the Southern
District of New York Judge
Ronnie Abrams on June 15 held
a proceeding with Joel Pena,
charged with wire fraud and
identify theft. Inner City
Press covered it.
Pena asked
for 3 minutes with his lawyer
Stumpur, who asked if the
Corrections Officer was right
next to him. He was.
Stampur
asked everyone on the line to
hang up. Judge Abrams' deputy
pointed out that lawyer and
client can hang up and speak
separately.
Pena was
set to plead guilty to Count 2
of the indictment, now an
Information, Aggravated
Identity Theft. The original
complaint, including as to
other defendants, had 13
counts and talked about
Bitcoin.
The plea
was taken, and no expedited
Pre-Sentencing Report was
ordered. Pena pled to a count
with 2 year mandatory minimum,
while AUSA Neff emphasized a
different plea was offered
with no minimum. Why?
The case is US v
Pena, 18-cr 640
(Abrams).
