Litigation Ensues

SDNY COURTHOUSE,
June 9 – Luis Batista began
work as a Server Assistant at
The Palm at 250 West 50th
Street in October 2016. But he
wanted to be a server. He was
told he might well be promoted
as The Palm "seeks to promote
from within."
But The
Palm went outside and hired a
Caucasian J. Fortney, "with
zero prior restaurant
experience."
Batista sued.
On June 9
U.S. District Court for the
Southern District of New York
Judge Lewis J. Liman held a
proceeding. His deputy, once
with the mediation program,
asked who was on the line.
"Inner City Press, not a
participant."
Judge
Liman listened to the two
sides, then urged them to
avail themselves of the
assigned Magistrate Judge,
Kevin N. Fox. He also set the
end of discovery at September
21, with another conference on
October 1.
The case is
Batista v. Palm West
Corporation et al.,
19-cv-04455 (Liman).
