Sentence Asks For Re Sentencing From SDNY

SDNY COURTHOUSE,
April 28 –
Luis Jiminez was given a life
sentence for selling over a
kilo of crack in the Bronx in
the 1990s.
On April 28
amid the Coronavirus pandemic
he applied for resentencing
under the First Step Act, in a
proceeding before U.S.
District Court for the
Southern District of New York
Judge Jed S. Rakoff that Inner
City Press covered.
Jiminez' pro bono lawyer told
Judge Rakoff, You should only
rely on the 1.5 kilos in the
indictment.
Judge Rakoff quickly replied,
But he said under oath that
his Drug Trafficking
Organization sold 15 kilos.
Assistant US Attorney Mary
Christine Slavik said that her
Office "has not yet retrieved
the entire file in this
matter."
Judge Rakoff asked for letters
in the next few days, after
the oral argument.
AUSA Christy Slavik jumped in
to say that Mr. Jiminez is a
citizen of the Dominican
Republic, adding that she will
supplement that in her letter.
Judge Rakoff mused, Probably
no detainer was lodged since
he got a life sentence. Then
he returned to the practical,
saying that normally sentences
are done orally, because
defendant present. So in this
case I can issue an
order and an amended judgment.
Letter by close of business
Thursday. I'll issue my order
next week. The case is US v.
Jiminez, 92-cr-550
(Rakoff).
