SDNY COURTHOUSE,
Feb 8 – Stewart M. Smith
sued Tishman Construction for
discrimination based on
disability under the
ADA.
On February
8, U.S. District Court for the
Southern District of New York
Magistrate Judge Stewart D.
Aaron held a proceeding. Inner
City Press covered
it.
Smith's pro
se complain says "shortages
resulted in the Plaintiff
being outside and exposed to
the Caribbean sun over 95% of
the time."
Tishman
wants to move to dismissed.
Judge Aaron said
dismissal of a pro se
plaintiff's claims for missing
a deadline is not favorably
viewed in the Second Circuit
and he asked defendants to
keep that in mind.
The case is Smith
v. Tishman et al., 21-cv-2915
