before U.S. District Court for
the Southern District of New
York Magistrate Judge Barbara
Moses on October 8. Inner City

AUSA: "Defendant
was arrested this morning, at
6 am, in The Bronx."
SDNY Magistrate
Judge Moses: You have the
right to remain silent... If
you are a foreign national you
have the right to have your
consulate notified
Defendant Jose
Serrano is paying for his
lawyer, unlike Michael
Avenatti & David Correia,
both of whose applications

AUSA: As soon as
docketed on PACER [it already
is] assigned Judge [Schofield]
will reach out to counsel
Judge Moses: Is
there a proposal?
AUSA: The
defendant discharged the
firearm. But because the
defendant has been indicted in
the state as well, we will set
conditions of bail: $25,000
bond, travel restricted to
SDNY, surrender of passport,
drug testing
Judge Moses: I
notice, Mr. Serrano, that you
have a tremor, in your head.
Is this anxiety?
Defense lawyer:
It's a long story. He was left
near a radiator when he was a
child... I represent him in
state case, it's been going on
for a year. He's an elevator
maintenance worker
Defense lawyer:
We want EDNY travel as well.
He works on elevators in
Brooklyn and Queens. He goes
to church three times a week.
Judge Moses: I
agree to bail. A week for
co-signers on the $25,000
bond. Do you understand?
Serrano:
Y-y-y-ess Y-y-your Honor
[shaky]
Judge Moses. We
will be adjourned.
