Carlos Alvarez Chicas sued
Kelco Construction, Inc. which
worked on the 9/11 Museum and
The Brooklyn Bridge Park, for
not paying prevailing wages
under these and other public
works
contracts.
On March 3, U.S. District
Court for the Southern
District of New York
Magistrate Judge Stewart D.
Aaron held a proceeding. Inner
City Press covered it.
Among the
issues is how defendant will
produce pay records. Is it
requiring the plaintiff to go
to third parties? No. But
maybe the records will only be
provided as they are, in PDF.
Judge Aaron
noted that there is software
now to convert from PDF. He
said he would endorse the Case
Management Plan, which has
fact discovery runnings
through December 31, 2022.
