SDNY COURTHOUSE,
Jan 7 – More than a year ago a
hacker pleaded guilty and was
to be sentenced on December 3.
But due to technological
problems, ironically, it was
postponed.
Back on
September 23, 2019 then- U.S.
Attorney Geoffrey S. Berman
said: “Andrei Tyurin’s
extensive hacking campaign
targeted major financial
institutions, brokerage firms,
news agencies, and other
companies. Ultimately,
he gathered the customer data
of more than 80 million
victims, one of the largest
thefts of U.S. customer data
from a single financial
institution in history.
With today’s plea, Tyurin’s
global reign of computer
intrusion is over and he faces
significant time in a U.S.
prison for his
crimes.”
So on
December 3, 2020 Tyurin with a
Russian interpreter was ready
to be sentenced.
But the CourtCall
platform was deemed not to
work well.
Inner City Press
had called in; there was
discussion of shifting the
sentencing to AT&T,
audio-only. But it had to be
put over:
January 7, 2021,
at 9:00 a.m. No conference
date, time or modality can be
confirmed before the end of
the preceding week, so counsel
are requested to keep their
calendars open between the
hours of 9 a.m. and 2 p.m. on
January 7, 2021, until further
notice."
It was
rescheduled to 11 am, and
didn't begin until nearly
noon. Thereupon, Inner City
Press live tweeted this:
Now Andrei Tyurin
is being sentenced, for
hacking JPMorganChase etc. US
Attorney's Office says it is
important that hackers are
harshly sentenced, for
deterrence.
Tyurin (in
Russian): I committed a crime
and I should bear
responsibility for that. I
caused a lot of harm to a lot
of people. I regret but
I cannot turn back time.
That's all.
Judge Swain: Ms
Ng, please re-mute Mr. Tyurin.
[Because interpreter can be
heard]. The offense level is
36, history is 1. The
guideline is 188 to 235
months.
Judge Swain:
After illegal hacking, Mr
Tyurin became a White Hat
hacker. His remorse seems
genuine. The goals of
sentencing require a
substantial custodial
sentence. You are to serve 144
months, Mr Tyurin, then
deportation. Restitution is
deferred to April 6.
Afterward, this,
from still-aacting U.S.
Attorney Audrey Strauss:
“From his home in Moscow,
Andrei Tyurin played a major
role in orchestrating and
facilitating an international
hacking campaign that included
one of the largest thefts of
U.S. customer data from a
single financial institution
in history, stealing the
personal information of more
than 80 million J.P. Morgan
Chase customers. The
conspiracy targeted major
financial institutions,
brokerage firms, news
agencies, and other companies,
and netted Tyurin over $19
million in criminal
proceeds. Now Tyurin has
been sentenced to 12 years in
prison for his crimes.”
It was said
in 2019, "TYURIN is charged
with committing these crimes
with Gery Shalon, a/k/a “Garri
Shalelashvili,” a/k/a
“Gabriel,” a/k/a “Gabi,” a/k/a
“Phillipe Mousset,” a/k/a
“Christopher Engeham”; Joshua
Samuel Aaron, a/k/a “Mike
Shields”; and Ziv Orenstein,
a/k/a “Aviv Stein,” a/k/a
“John Avery,” in furtherance
of securities market
manipulation, illegal online
gambling, and payment
processing fraud scheme.
Inner City
Press will continue to cover
this case.
It is US v.
Shalon et al, 15-cr-333
