Court Two More Co-Defendants, One Released
But No Social Media Posting

SDNY MAG COURT,
July 7 – In the Magistrates
Court of the U.S. District
Court for the Southern
District of New York on July
7, co-defendants Maxwell Smith
and Deuri Carambot were
presented together, both in
yellow overalls from the Essex
County jail. The results were
different.
Both are
part of a multi-defendant
Bronx drugs and gun case.
Assistant US Attorney Matthew
Hellman sought detention for
both. Carambot consented to
detention, without prejudice,
and was led away. Smith's
lawyer Calvin Scholar made a
bail argument.
Hellman
said that Smith has shot a
gun, linked to him by DNA, and
had an "online persona" with
"online loyalty" to the gang.
Judge Cott
like the day before took a
break with Pre-Trial Services
and his staff, this time
longer. When he emerged, he
arrived at home incarceration,
with an additional condition
that Smith engage in "no
posting on social media" of
any kind, "on any topic."
In the
insurrection / Capitol breach
cases Inner City Press is
reporting on in the DDC, this
condition is found
objectionable, even
unconstitutional. How might
Judge Jed S. Rakoff view it?
Magistrate Judge Cott, to his
credit, encourage Scholar and
other counsel to raise any and
all arguments to Judge Rakoff.
