SDNY COURTHOUSE,
Jan 10 – Da Marino Restaurant
of 240 West 49th Street in
Manhattan was sued for
overtime and spread-of-hours
pay.
It was willing to
settle for $30,000 then
couldn't pay due to the COVID
lockdown.
On January
8, U.S. District Court for the
Southern District of New York
Judge Vernon S. Broderick held
a proceeding. Inner City Press
covered it.
The
restaurant's lawyer said it
was not through ill-will, that
they want to pay and will be
trying to re-open the
restaurant.
The plaintiffs'
lawyer said it was hard to
convince the clients to wait.
A new status
letter is due March 12.
The case is Luna
et al v. Fratelli Italiani LLC
et al., 19-cv-10849
(Broderick)
