SDNY COURTHOUSE,
May 17, updated – Yutong
Jin sued Columbia
University affiliate Solomon
Choi for sexual assault. He
has asked for ten years of her
medical and mental
records.
On January
12 U.S. District Court for the
Southern District of New York
Judge Mary Kay Vyskocil held a
proceeding. Inner City Press
covered it, and then reported
some of it. Then it
covered the next conference on
February 23, at the top of
which the parties were told
that it was a public
proceeding that the public had
accessed.
Judge
Vyskocil to her credit told
Choi's two lawyers it was not
fair for them to "tag team" a
pro se plaintiff. They replied
that since the plaintiff is
accusing their client of given
her a venereal disease, they
have a right to know if she
ever had one.
Why not
just two years before?
Because, they argued, if she
had it she would stop getting
treatment.
The complaint
cites a South Korean drama,
"Descendants of the Sun." We
are leaving out other details.
On February 23,
Judge Vyskocil put the parties
on notice again, the call-in
information was on ECF and was
being used. The pro se
plaintiff has made many filing
since the last conference,
including messages with
Solomon Choi, from her as
Scarlett Jin. Choi says, "I
kissed girl on my birthday but
it didn't lead to anything
more. And I also made out with
someone during finals but
again, it didn't lead to
anything more."
Now
on May 17, after Magistrate
Judge Stewart D. Aaron
scheduled a show-cause hearing
on dismissing the case, two
filings have been made, "to
file case under seal" and
"request for filing under
seal." Both say, "You do not
have permission to view this
document."
This case is Jin
v. Choi, 20-cv-9129 (Vyskocil
/ Aaron)
Update: The above accurate piece
has given rise to a threat of legal action
which in fairness we publish here: "Dear
Inner City Press, I
would like to request you to stop posting
about civil suit between Solomon Choi and
Yutong Jin. This case has already
been concluded after a settlement. I
am suffering continuous damage from the
writing on this site even though the case
is already over. If you don't accept
my request, I have no choice but to take
legal action."
