Met Life Sues Two Widows of
Building Worker With ERISA Claims Before SDNY

SDNY COURTHOUSE,
June 15 – Jose Luis Lopez has
in the Buildings Services 32
B-J union and its ERISA health
fund when he died.
Then Met
Life sued two women in The
Bronx, to determine to whom to
pay his benefits.
Met Life wrote,
"upon information and belief,
Thelma Lopez was either the
wife or ex-wife of the
decedent" and "upon
information and belief Maria
Solenilda Severino was the
wife of the Decedent."
On June 2,
Met Life's counsel wrote to
U.S. District Court for the
Southern District of New York
Judge Lewis J. Liman that
"both Ms. Servino and Ms.
Lopez only speak Spanish.
Accordingly, a translator is
necessary for the
defendants."
Judge Liman
replied in his endorsement
that "The Court does not have
the ability to provide
interpreters to litigants in
civil cases except to
litigants who are deaf,
hearing-impaired, or have
other communications
disabilities."
He referred
to NYLAG and the SDNY
Interpreters Office. On
June 15 Judge Liman held a
proceeding, and Inner City
Press covered it. There was
discussion of divorce.
At issue are some
$52,000, now in an interest
bearing account.
The case is
Metropolitan Life Insurance
Company v. Lopez et al.,
20-cv-1076 (Liman).
