LIRR Crowbar Accident Leads
to Questions of When SDNY Civil Jury Trials

SDNY COURTHOUSE,
May 27 – Kenneth Wilson was
injured in Long Island
Railroad's Building 4 in the
West Side Yard in Manhattan on
July 12, 2017. His co-worker
"moved a crowbar, trapping
[Wilson's] right middle
finger."
He sued.
On May 27,
U.S. District Court for the
Southern District of New York
Magistrate Judge Stewart D.
Aaron held a conference in the
case. Inner City Press covered
it.
Like much
litigation under the Federal
Employers' Liability Act, the
counsel knew each other, and
predicted they can settle it.
Judge Aaron asked
if LIRR is still running,
noting that he lives in
Westchester County where Metro
North is running but only for
essential
workers.
The two counsel
agreed that LIRR is in
operation. They asked Judge
Aaron when he thought jury
trials in the SDNY will
resume.
Judge Aaron
predicted criminal jury trials
in September, with civil
trials later. Depositions -
remote - are due by August 31.
The case is
Wilson v. Long Island Railroad
Company, 19-cv-11231 (Nathan /
Aaron).
