SDNY COURTHOUSE,
Nov 27 – Johirul Islam, from
Bangladesh, was granted asylum
in the United States after
entering through Hidalgo,
Texas in 2016, but now can't
get action on his I-495
application for permanent
residence status.
So on November
26, the day after
Thanksgiving, he
sued.
The complaint,
which Inner City Press found
that day in the docket of the
U.S. District Court for the
Southern District of New York,
says the plaintiff is not
required to exhaust
administrative remedies since
the case involves a
constitutional due process
challenge to administrative
action, citing Wang v.
Reno, 81 F.3d 808, 9th
Cir 1996.
