In SDNY Carl Marshall Gets
10 Months For Gun Possession MCC Not MDC

SDNY COURTHOUSE,
Dec 13 –
Carl Marshall was presented on
charges of Violations of
Supervised Release by having a
gun, and was bailed for
$100,000 bond on August 12 in
the U.S. District Court for
the Southern District of New
York Magistrates Court.
SDNY Judge P. Kevin Castel,
days after holding an
evidentiary hearing, on
December 13 sentenced Marshall
to 10 months in prison for the
violation.
Marshall
did not testify under oath at
the evidentiary hearing; at
sentencing he professed his
innocence. Judge Castel said
he would not consider either.
He also imposed two more years
of Supervised Release.
US Marshalls who had been
waiting in the back of the
courtroom quickly moved
forward and took Marshall into
custody. Judge Castel noted
that Marshall has been before
him since 2006 and said he is
rooting for his to turn his
life around.
Marshall's lawyer
Alan M. Nelson asked Judge
Castel to recommend that
Marshall be housed in the MCC
and not the MDC, where he had
concerns. Judge Castel said he
would make the recommendation.
The case is US v. Marshall,
06-cr-538 (Castel).
