SDNY COURTHOUSE,
Oct 4 – Cesar Augusto Garcia
Salvador worked at a liquor
store at 812 10th Avenue in
Manhattan but was not paid
overtime.
He was "carrying
down boxes of liquor to the
basement, bring up liquor from
the basement, cleaning the
basement and placing bottles
of liquor on the stands." He
sued.
On October 2,
U.S. District Court for the
Southern District of New York
Magistrate Judge James L. Cott
held a proceeding. Inner City
Press covered it.
The plaintiff's
lawyer said it would probably
not be a class or collective
action. Judge Cott said that
seven months for discovery
seemed too long. He referred
the parties to the SDNY
mediation program.
The case is
