Dentist Sued By Former
Employer Hits HIPAA Claim As Harassment In

SDNY COURTHOUSE,
Oct 18 – AA Medical P.C., a
dentist's office on 41st
Street in Manhattan, sued its
previous employee Khaled
Almansoori for violating HIPAA
and the Computer Fraud and
Abuse Act by accessing a
protected computer and
improperly disclosing
patients' records.
On October
16 U.S. District Court for the
Southern District of New York
Judge John P. Cronan held a
proceeding. Inner City Press
covered it.
Almansoori's
lawyer says his client is
being harassed, including in a
similar case in the EDNY
before Judge Joann Seybert. He
asked Judge Cronan to transfer
this to the first-filed case.
He asserts that
"violation of privacy is not a
cause of action."
Judge
Cronan, offering a Supreme
Court citation, set an October
30 deadline for the dentist -
plaintiff to file an amended
complaint or respond to these
arguments.
